Description

Section 4(f) refers to the original section within the U.S. Department of Transportation Act of 1966 which provided for consideration of park and recreation lands, wildlife and waterfowl refuges, and historic sites during transportation project development. The law, now codified in 49 U.S.C. 303 and 23 U.S.C. 138, applies only to the U.S. Department of Transportation (U.S. DOT) and is implemented by the Federal Highway Administration (FHWA) and the Federal Transit Administration through the regulation 23 Code of Federal Regulations (CFR) 774.

This presentation will go over the basic understanding of the rule as well as where Section 4f and Section 106 of the National Historic Preservation Act intersect. Participants will gain knowledge in the law as well as considerations that will need to be taken in their projects.

David Clarke, Federal Preservation Officer (FPO) for Federal Highway Administration (FHWA). David has over 25 years of experience in Historic Preservation and has worked in the public and private sectors as well as academia. David holds a BA in Anthropology / Archaeology from Mercyhurst University and a MA in Anthropology / Archaeology from the University of Montana. As the FHWA FPO David has agency wide authority on FHWA's compliance with Section 106 of the National Historic Preservation Act, and therefore also Section 4(f) compliance and Tribal Consultation.
